1. On 13.9.2012 on the apprehension of the petitioner that Azhar Iqbal, brother of the petitioner is detained by a Brigadier at Malir Cantonment . The DIG was directed to call for the information from the concerned which was not received. This Court on 13.9.2012 directed the DAG to ensure that affidavits of the concerned officers are filed. It is informed that the learned DAG on 18.9.2012 addressed a letter to the Secretary Ministry of Defence so also the Commanding Officer Malir Cantonment Karachi alongwith a copy of the order of this Court. It was cautioned that in case the information called for is not furnished, the Court will be within its rights to summon the Commander, Malir Cantonment.

Since despite the categorical letter addressed by the DAG to the Secretary, Ministry of Defence and so also the Commanding Officer, it is noted with concerns and dismay that no response and respect to the order and direction of the Court is given. The Court has exercised restraint earlier and issued direct notice to the Commander, Malir Cantonment in the expectation that respect of law will prevail which unfortunately was not done. We, therefore, are left with no option but to issue notice to the Commander, Malir Cantonment to show cause as to why he may not be committed for any subordination to the order and direction of the Court. A copy of this order may be sent directly to the Officer concerned as well as learned DAG, who may himself ensure that such orders are communicated not only to the Secretary, Ministry of Defence but also to the Commander, Malir Cantonment.
