Muhammad Ali Mazhar J. This order will dispose of following constitution petitions:-
1. C.P No.D-2342 of 2015: Sixteen petitioners have prayed for the directions against respondent No.3 to issue their appointment orders for the post of Assistant Sub-Inspector (BPS-09) without any further delay as they have qualified the recruitment process.
2. C.P No.2538 of 2015: This petitioner has also prayed for the directions against the respondents to issue notification of his appointment pursuant to the recommendations of respondent No.5 i.e Sindh Public Service Commission.
1.The learned A.A.G and Mr.Abdul Aziz, Assistant Director, Sindh Public Service Commission both have clearly stated that the Sindh Public Service Commission has already declared the petitioners of both the petitions successful for the appointment and has forwarded their recommendations to the competent authority for consideration but the decision is waited, however as soon as the competent authority will pass the orders on recommendations , the recruitment process will start and appointment letters will be issued. The similar statement is also reflecting from their comments filed separately in the aforementioned petitions. The learned A.A.G requests for sixty days' time to consider the matter by the competent authority.
2. The learned counsel appearing for the petitioners argued that in view of statement made by the learned A.A.G, the directions may be issued to the respondents with some exact time frame to consider the recommendations of the Sindh Public Service Commission and issue appointment letters of the petitioners but sixty days' time is too long and due to delay in the matter the petitioners are suffering hardship.
3. Since the matter is much delayed and still the recommendations are kept in abeyance therefore both the petitions are disposed of with the directions to the respondents to expedite the process and after considering the recommendations of Sindh Public Service Commission issue the appointment letters of the petitioners within 45 days. Copy of this order may be transmitted to the learned Advocate General Sindh, Mr.Abdul Jalil Zubedi, Assistant Advocate General Sindh, Secretary Home Department and Inspector General Police, Sindh for ensuring the compliance.
