1. ' MAQBOOL BAQAR, J. --- The applicant, who is a complainant in Sessions Case No, 520/2012 pending before the learned Addl. Sessions Judge, Naushahro Feroze, is seeking transfer of the said case to a Court in Hyderabad. Learned counsel for the applicant submits that the respondents, who are facing trial for murder of the applicant's brother in the above case have been threatening the applicant to kill him in the event he pursues the above case, and on 6.8.2012 the applicant appeared before the Trial Court the relatives of the accused, namely, Sadaruddin, Naik Muhammad, Arbab, Amb alongwith two unknown persons armed with deadly weapons pointed their weapons towards the applicant and threatened him that if he continued to pursue the above case he shall be killed and it was only when he tried for help his life could be saved that day, and thereafter the applicant lodged an FIR of the incident being FIR No, 180 of 2012 at P.S. Naushahro Feroze.
2. Learned counsel submits that it is on account of above threatening situation the applicant has not been able to appear before trial at Naushahro Feroze and the case is being adjourned since long. The learned counsel requests that the application be granted and the case be transferred to any Court in Hyderabad.
3. ' The request is opposed by the learned DPG; she submits that transfer of the case would cause great inconvenience to the prosecution as well as to the witness and may cause further delay in the conclusion of the trial.
4. ' Through notices were repeatedly sent to the respondents and respondent No, 1 has also been duly served whereas respondents No, 2, 3 and 4 have refused to receive such notices. None is present on their behalf to oppose the transfer application.

' Since the applicant is being allegedly threatened to be killed in case he pursues the above case and in fact an FIR, as noted above, has been lodged by the applicant against the accused on whose behalf he has been threatened, I find it appropriate to order transfer of the case being Session Case No, 520/2012 from the Court of Addl. Sessions Judge, Naushahro Feroze to the learned District & Sessions Judge, Hyderabad, so that, he may either try the same himself or transfer the case to some Addl. Sessions Judge within his jurisdiction with an order for expeditious conclusion of the trial. Case transferred.
