' S. HAMM RAHMAN (MEMBER).-In this case Abdul Ghaffar, who was serving in the Police as Assistant Sub-Inspector, has been retired from service under section 12 (ii) of the Punjab Civil Servants Act, 1974, and impugns in this connection the retirement order dated 15th January, 1980 passed by the Superintendent of Police, Jhang. During the pendency of this appeal, the representation/appeal made to the D. I. G. Concerned was rejected.

2. We have heard the parties and, calling for the record of the case, went through it in the light of the appellant's arguments. The appellant has completed 25 years of service qualifying for pension and other retirement benefits there is no doubt that the impugned order was issued competently and no personal malice or mala fide on the part of the authority was alleged, It was, however, submitted that the decision to retire the appellant was taken by a Committee and that the S. P. Had hot exercised his independent mind in this behalf. We examined the record and found that the S. P.

Had not specifically recommended the appellant's retention in service. Thus there is no ground on which this I appeal could be accepted, and it abates in accordance with the relevant provisions of the Provisional Constitution Order, 1981.

3. As a consequence the appeal is dismissed in limine. The appellant, may, however, file an appeal, with the competent authority, if so advised, as provided in the P. C.
