' ALI BAQAR NAJAFI, J. --- Through this constitutional petition the petitioners seek a direction to respondents No,. 2 to 4 to cause any illegal and undue harassment to the petitioners and to comply with the order dated 09-04-2u13 passed by the A.S.J/Ex-Officio Justice of Peace, No,orpur, District Khushab.
2. Brief facts giving rise to the filing of the petition are that FIR No,. 36/2013, dated 26.3.2013 under section 377, PPC was registered at Police Station No,orpur, District Khushab against the real son of the petitioners, whereafter respondents No,. 2 to 4 started raiding the house of the petitioners. The two sins of the petitioners initially joined the investigation and then pre-arrest bail was granted to them but later on they absconded. Their whereabouts are not known to the petitioners. On this the petitioners filed a petition under Sections 22-A & 22-B, Cr.P.C. Before the Ex-Officio Justice of Peace who was pleased to pass an order dated 09.04.2013 directing respondents No,. 2 to 4 to cause any illegal harassm ent to the petitioners. However, the said order is not being complied with. Hence this petition.

Learned counsel for the petitioners submits that the petitioners being fathers are not responsible for the acts of their two sons; that if they are required in any case the police may arrest them but cannot harass the petitioners by raiding their houses and threatening family members; that under Islamic provisions the father cannot be charged for the crimes of his sons. Hence prays for the direction.

9. The order dated 09.04.2013 directing the SHO/respondent No,. 2 not to cause any illegal harassm ent to the petitioners is very clear and explicit. Such orders are always subject to the law. If the petitioners have any knowledge of the whereabouts of the accused persons in the said criminal case, they cue proud to disclose it before the police and they must not hide them under their protection.

This petition is disposed of with the direction to respondent No,. 2/SHO not to cause any illegal harassm ent to the petitioners in compliance of order dated 9.4.2013 passed by the learned Ex- Officio Justice of Peace rather to cause arrest of the accused nominated in the FIR lodged by respondent No,. 5 and for that the petitioners are bound to cooperate with law enforcing agencies.
