' FAKHRUDDIN G. EBRAHIM, J.-In 1961 the petitioner joined with respondent I.D.B.P. At the time of the fall of Dacca in December, 1971 the petitioner was working with I. D. B. P. At Dacca. It is his case that with great difficulty he reached United States in December, 1973, applied for a Pakistani Passport in January 1974, obtained it on 11th March, 1974 arrived at Karachi on 24th March, 1974 and reported for duty on 26th March, 1974. The I. D. B. P. Did not grant the request solely on the ground that the Federal Government to which the petitioner's case had been referred to had decided not to permit the petitioner to continue in service "even through re-employment". The petitioner's case is that in terms of the Federal Gevernment's Office Memorandums dated 9th October, 1972 and 6th December. 1973 appearing at pages 81 and 79 of this Petition he was bound to be absorbed by the I. D. B. P.
2. The petitioner's complaint is that he has not even been informed of the reasons why he was denied his request to re-join I. D. B. P. The Federal Government in its counter-affidavit has given several reasons for not acceding the petitioner's request but it is conceded by the learned Deputy Attorney-General that at no time the petitioner was afforded an opportunity of meeting the grounds for this refusal. The learned Deputy Attonney General stated that the Federal Government was prepared to give an opportunity to the petitioner of being heard in the matter. We, therefore, direct that the Federal Government will decide afresh the question of petitioner's absorption or re- employment with the I. D. B. P. After giving the petitioner an opportunity of being heard in the matter. Since the petitioner is out of employment since 1974 we expect that the Federal Government will expedite and decide afresh, possibly within three months hereof.
3. At the request of the learned Deputy Attorney-General a copy of this order will be furnished to him to enable him to take early action.
4. The petition is disposed of in terms aforesaid with no order as to costs.
