1. This case has been filed by Salah ud Deen Malik stating that a Car Suzuki Alto Bearing Reg. No. LWQ8233 Engine No. 195938 Chassis No. 500023 Model 2005 was obtained on the lease under the Auto Loan No A0601260701 from the respondent Bank. All the dues/installments have been paid as a result of which the respondents have issued order for release of lien and transfer of ownership of vehicle in favour of the complainant but original file of the vehicle could not be handed over to the complainant inspite of repeated request and legal notice which amounts to deficient service on the part of respondents. The respondent in response to the summon issued by this court appeared and filed reply stating that they are ready to handover the duplicate file of vehicle.
2. I have heard the counsel for the parties. Transaction between the Bank and complainant about the vehicle in question is an admitted fact. Respondents have not raised any claim against the complainant about the lease money or any other dues of the vehicle in question. To my query as to handing the duplicate file to the consumer the learned counsel for the respondents submitted that the original file has been lost. The respondents were bound to deliver the original file to the consumer but they did not, therefore, they have failed to provide the services to the consumer from any deficiency, hence are liable to compensate the consumer. Therefore, according to the depreciation in the price of the vehicle Suzuki Alto due to loss of original file respondents are directed to pay Rs. 60000/- to the consumer/complainant/owner of the vehicle along with Rs.
3. 10000/- as legal expanses. Complaint is disposed off being borne fruitful. File be consigned to record room after due completion.
