Moazzam Hayat, Member.--Appellant Muhammad Munir was allowed Selection Grade BS-9. He was getting pay at the maximum of BS-10 by virtue of move-over, therefore, he was not allowed one increment on grant of selection grade. Aggrieved by that he has filed the present appeal.
2. The appeal is resisted by the respondents. It is stated that the appellant has already reached the maximum of BS-10 by move-over, therefore, he could not be given any increment.
3. We have heard the appellant, learned counsel for the respondents, the departmental representatives of the respondents and have also perused the record.
4. It is a novel case. The appellant had reached the maximum of BS-10 by move-over but selection grade in BS-9 was granted to him subsequently. He was already drawing much more pay in BS-10, therefore, in our view he was not entitled to any further increment beyond the maximum of BS-10 granted to him by move-over. If he is granted one increment for selection grade in BS-9, it shall be an exercise in futility since he is getting pay at the maximum of BS-10. He cannot be granted increment, admissible to grade 10 employees, since he is in that grade by move-over whereas selection grade was given to him in BS-9.
5. The civil servants get increment beyond the maximum of pay scale as personal pay on promotion when they are already drawing pay at the maximum of promotion cadre. However, in this case the appellant cannot be given any relief since he is getting pay in BS-10. There is no sense in granting him further increment which shall increase his pay beyond even the maximum of BS-10.
He shall indirectly enter in BS-11 and that shall be against all cannons of justice, equity and fair play.
6. We thus find no merit in the appeal which is hereby dismissed.
