APPLICATION FOR IMPLEMENTATION OF ORDER DATED 12-03-2010
1. The case is at the stage of the arguments about the jurisdiction of this court which have been heard today by the parties as such I proceed to dispose off the application by discussion in the following paragraphs:-
2. The version of the petitioner being the purpose of filing the present application is to implement order dated 12-03-2010 by which the Standing Review Committee was directed to settle the dispute. The report of the said committee dated 09-08-2011 is on the file according to which the committee has settled the matter against the petitioner by mentioning the disputed charges without any reduction.
3. Since it is settled law that the detection bill can not be challenged before Consumer Court as already in the un reported judgment in the case titled Mst. Shaheen Akhtar etc. Vs. Superintending Engineer MEPCO etc, bearing FAO No. 78/09 therefore the petitioner is directed to challenge the findings of the Review Committee before the Learned Civil Court because no further proceedings can be taken up to this court due to the prohibition of the nature.
4. For what has been discussed above, the application is hereby disposed off accordingly.
5. Parties are left to bear their own costs.
6. The file of this complaint is to be consigned to the record room duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed.
