1. M. SALEEM CHAUDHRY (CHAIRMAN).-In this case the appellant, an Assistant in the office of Director Public Instruction, is aggrieved by the wrong fixation of his seniority on 21st February, 1957.
2. According to the appellant he has been making representations to seek rectification in his seniority ranking. According to the details of representations supplied by him in para. 8 of the appeal, he made about 7 representations before 5th September, 1969 and an equal number of representations thereafter. However, it was conceded in the same paragraph that the final seniority list was published on 1st July, 1969 affirming the position assigned to the appellant in 1957.

Obviously the earlier representations filed by the appellant are deemed to have been taken into consideration, in view of the rule laid down by this Tribunal in the judgment reported as Muhammad Idrees Khalid etc. v. Public Health Engineering Department that the failure of the civil servant concerned to approach the Punjab Services (Appellate) Tribunal under Ordinance IV of 1970, after the expiry of a period of three months of the issuance of the final seniority list and the rejection of his representation, disentitled him to approach this Tribunal. Thus the present appeal is not maintainable. Even otherwise we find that the final order complained against by the appellant in this appeal is dated 1st July, 1969. Assuming that there was no other decision, the appellant was required to come to as within six months of the establishment of this Tribunal i,e, by 21st January, 1971 at the latest or after the expiry of for months of filing of the representation post establishment of this Tribunal. This Tribunal was established on 2nd July, 1974 and the last representation of the appellant was made on 8th May, 1975. Thus the appellant could wait for for months after filing his last representation which period also expired somewhere in September, 1975. The present appeal having been A filed on 18th March, 1976 is plainly barred by time and is dismissed accordingly.1
