1. The case is at the stage of the summoning of the respondent and since it is being stated by learned counsel for the petitioner that exparte order under implementation is being cancelled due to the proceedings of the separate application being passed in the file of the concerned application as such no need to pursue the present application having become anfractuous.

2. In accordance with above situation, the present application is hereby disposed off as having been anfractuous due to the proceeding of the separate application.
