1. ' SHAHID ANWAR BAJWA, J.--- F.I.R. No.55 of 2011 was recorded at P.S., Khenju on 21-7-2011 at 1230 hours for an incident, alleged to have taken place on the same date at 0010 hours. Complainant was Inspector, S.H.O. Muhammad Qabil Bhayo. He stated that he along with a Police party of five persons had gone in a vehicle for patrolling and while they were so patrolling, they received information that one female abductee was in the process of being returned through some influential person of the locality and who had been abducted by 10 persons and was being strangulated in order to kill her. Police party moved towards the pointed place and saw in the light of vehicle that ten persons were grappling with a woman and were strangulating her. Upon seeing Police, the alleged abductors/assassins managed to escape. The alleged abductee was found lying dead in the field. Present applicants are six of the ten persons, who are alleged to have abducted and murdered that woman.
2. ' Learned counsel for the applicants submitted that it is alleged in the F.I.R. That a female was strangulated and this could be done even by one person and, therefore, allegations against the present applicants are, firstly, of general nature and, secondly, it is a case of further inquiry.
3. ' Learned D.P.-G. Vehemently opposed the bail application and submitted that the applicants are named in the F.I.R. And have committed a very heinous crime of killing a woman who was in very advanced stage of her pregnancy.
4. ' I have considered the submissions, made by the learned counsel and have also gone through the record.
5. ' Alleged abductee Mst. Soomri is stated to be in her eighth month of pregnancy and has been brutally murdered in a field and the present applicants were duly identified by the complainant.
6. ' Those, who commit offence on a female, deserve the least amount of leniency and concession of discretionary relief by the Courts. Our society appears to have degenerated to a point where the females, particularly in the rural areas, which females, under the religion in which all of us believe, have equal human rights and same is the position under the Constitution of Islamic Republic of Pakistan, are being treated in a manner worse than, much worse than, the way animals are treated. They are killed with impunity, tortured without any remorse and mistreated in a way unworthy of any human being. It is high time that the Courts adopt an activist approach and those, who are alleged of having committed a' crime on women and, in this case the woman, was a pregnant woman and was still in the budding years of youth, are shown a conduct as harsh as the crime is despicable.
7. ' Therefore, it is my opinion that the applicants do not deserve any discretionary relief. This bail application is consequently, dismissed. Listed applications are disposed of.
