The complainant filed the instant complaint against the respondents stating that he purchased Motorcycle Ravi, RA-70 Registration No.GAL-09/8622. Chassis No.HKF6648, Engine No.HKFOEE4382 on installments from the respondents and on 08-02-10 he went to showroom of respondents for payment of last installment and paid it and demanded the original documents but respondents required him to pay Rs.3000/- in contravention of terms and condition of an agreement in the name of clearance certificate. He refused to pay as it was against the sprit of agreement upon which they snatched his motorbike and confined him in a private room till the payment of Rs.3000/- upon this he made a telephonic call to his family and from village Zulifikar Ahmed S/o Anyait Ali and Naveed Abbass S/o Bashir Ahmed R/O Uggo Bhindar Tehsil Kamoki District Gujranwala came to him after 4 hours and after paying Rs.3000 the respondents released him alongwith Motorbike but the motorbike was not working properly and then he got it examined from a private workshop where mechanic told him that the vital parts of motorbike were of substandard quality. He claimed Rs.3000/- as an illegal payment received from him by the respondents, Rs.26000/- as a damages, Rs.450000/- as a damages for suffering mental torture and physical discomfort, Rs.3000/- as fee of legal notice and Rs.18000/- as a fee of counsel total Rs.500000/- from the respondents. Ultimately he sent a legal notice on 11-02-10 but no reply was made by the respondents.
2. The respondents did not appear in the Court despite of his service, therefore, exparte proceedings were initiated against them and case was fixed for exparte evidence.
3. In exparte evidence complainant appeared as PW1 and produced Zulifikar Ahmed as PW-2 in his support. The complainant as PW1 reiterated the same facts as mentioned in the complaint and produced copy of legal notice as mark "A", registration book of motorbike Exh. "PA", receipt of post of dispatch of legal notices Exh. "PB" and complainant closed his evidence.

In view of the exparte proceedings and corroborative evidence of complainant, I have left with no option except to believe the version of complainant, therefore, I hold that complainant is entitled to get relief from this Court, hence, the complaint is partially accepted in the following terms that:-
1. The respondents are liable to pay Rs.3000/- to the complainant which he received illegal from him.
2. The respondents are also liable to pay Rs.7000/- as counsel fee and legal expenses of proceedings.
3. The respondents are also liable to pay Rs.5000/- as compensation for suffering mental torture and inconvenience.
4. The respondents are also liable to pay Rs.5000/- as a fine which shall be deposited in the state treasury.
The respondents would be liable to pay all above payments within 30 days of announcement of this judgment without fail. The Registrar of this Court is directed to send a copy of this judgment to the respondents for compliance.
