1. Case of the complainant is that he purchased a cellular telephone connection bearing Number 0303-6005587 from respondent company two years ago which remained in his use. After some period Sim of the above said Number become invalid upon which respondent was approached who replaced the same with new one having the same number which further remained in his use.
2. A few months ago again the same position was faced by the complainant. Lastly on 7.7.2012 respondent's office was contacted who refused to activate the above said Sim. In this way the respondent has failed to provide proper and efficient service to the complainant.

Respondent was summoned who did not choose to appear inspite of the fact that one Abdullah Cheema of respondent's office has validly received the summons/notice issued by this court for which vide order dated17.9.2012 respondent was ordered to be proceeded ex-parte. The complainant himself appeared in the witness box as Pw-1 and verified contents of the complaint which remained un-rebutted because respondent due to willful absence was proceeded ex-parte.
4. Receipt Exp-P1 along with acknowledgment Exp-P2 for serving legal notice mark-A was placed on record by the complainant.

After going through the contents of the complaint along with statement of the complainant on oath as Pw-1 it is established on record that the respondent failed to provide proper service to the consumer. The Sim provided to the complainant by respondent is not working at present without any valid reason however, the complainant in this case has not produced any evidence regarding the damages suffered by him from the provisions of defective services except lack of benefit therefore, respondent is directed to return the consideration received from the complainant for the sale of Sim in question. Respondent is also directed to pay Rs. 1500/- as legal charges to the complainant. Complaint is disposed off accordingly. File be consigned to record room after due completion.
