1. Case of the complainant is that on 5.5.2012 at about 7/8:00 pm he went to the shop of respondent and paid Rs. 100/- to get the balance upload for calling time through Easy Load but the respondent failed to up load the requisite balance against his cell phone bearing No. 0300-6053379 . The matter was brought to his notice who instead of redressing the grievance of the complainant misbehaved and used filthy language.

2. Respondent was served notices but he did not choose to appear resultantly he was proceeded ex- partee vide order dated 20.06.2012. Complainant himself appeared as Pw-1 and verified the contents of the complaint he produced on record copy of the legal notice mark-A postal receipt Ex-P1 along with AD Ex-P2. Abdul Rehman Advocate of District Courts Sargodha appeared as Pw-2 to corroborate and support complainant's version.

3. I have heard the arguments and record perused.

From the ex-parte evidence it is established that respondent received Rs. 100/- and did not provided the requisite balance hours for cell No 0300 6053379 used by the complainant and when he was apprised of the fact instead of making an enquiry into the matter he misbehaved and in this way he not only failed to provide to the complainant a quality product but also futile to provide the service. Resultantly the complaint is allowed and respondent is directed to return Rs. 100/- to the complainant along with Micsl litigation charges Rs. 400/-. Respondent is also burdened to pay Rs. 500/- as fine in the state treasury within the one month of the passing of this order. File be consigned to record room after due completion.
