Brief facts of the case are that after purchase of suit premises, the petitioner approached the respondent for formal transfer of gas meter from one Jamal Din in petitioner's name. On 6-3-09, the petitioner also deposited necessary fee to effect transfer of meter. When petitioner's repeated demands for redressal of his grievance were not heeded by the respondent, he filed this petition.

2. In response to notice issued by the court, respondent appeared before court on 22-2-12 and was granted three adjournments to file written statement but ultimately them failed to do so. As a result, respondent's party proceeded ex-parte.

3. Petitioner appeared as PW-1 and also placed on record his sworn affidavit Ex-P-1, copies of application Ex-P-2, gas bill Ex-P-3 and copy of demand notice Mark 'P/A'.

4. Ex-parte arguments heard and record perused.

5. It would appear from the perusal of record that the petitioner did not serve any legal notice to the respondent as required by section 28 of Punjab Consumer Protection Act 2005. The effect of non issuance of notice is that no claim shall be entertained by the Consumer Court, vide sub- section 3 of section 28 ibid. As regards petitioner's request addressed to G.M SNGPL dated 6-3-09 even the same cannot save the petitioner from being non suited his even if letter dated 6-3-09 is treated as legal notice petitioner's claim becomes time barred and liable to be dismissed as such.

6. For what has been stated above, petition is dismissed with the direction that after completing necessary legal formalities, the petitioner may again approach the court if liked so. After due completion, file be consigned to record room.
