1. Claimant moved the instant claim to recover the semester fee and hostel dues to the tune of rupees 10,000/- paid to the respondent Tariq Bin Ziad Academy of Science. According to the claim of the claimant on the very next day when he deposited the fee and hostel dues he informed the respondent that he could not carry on the study of his son in his academy for which received fee and hostel dues be returned to him. Respondent promised to do so but later on he refused to do so for which present claim.
2. Respondent contested the claim by filing written statement. He contended that claimant has no right to file the present claim before this court because claimant do not falls within the definition of consumer. He also objected that this Court has no jurisdiction to try this case.

4. Bare perusal of the claim and prayer of the claim reflects that claimant wants to recover fee and hostel dues which he had paid to the education institution for his son's study. Claimant did not challenge the services of the respondent. Recovery suit cannot be filed before the consumer court.
5. It is the powers of the civil court to adjudicate the recovery suit. As the services of the respondent are not to be challenged as defective hence claim of the claimant is hereby dismissed. Claimant is directed to knock at the door of appropriate forum to recover his dues.
6. File be consigned after its due completion.
