COMPLAINT ABOUT FAULTY SERVICE OF HOTEL

2. The case was previously at the stage of the arguments but I was on leave on the previously fixed date i.e., 07-04-2012 and this date was fixed by the Reader on my standing instructions without recording formal order of said date.

3. Briefly stated the version of the claimant being to the effect that he had not paid any bill of the alleged meal ordered by him as such he does not fall in the definition of the consumer or even the beneficiary due to which he would have to resort to the civil court of general jurisdiction instead of this special court meant for actual consumers and beneficiaries.

4. In accordance with above situation, the complaint is hereby deemed to be returned due to want of jurisdiction for the filing of civil suit before the learned civil court.

5. Parties are left to bear their own costs.

6. The file of this complaint is to be consigned to the record room of this court duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed for destruction in accordance with the Rules & Orders of Honourable Lahore High Court.
