COMPLAINT ABOUT FAULTY SERVICES

2. The case is at the stage of the filing of the written reply which has been filed on behalf of the claimant while original affidavits have been filed along with copies of CNICs and copy of a register on behalf of defendant No.1.

3. Now the case is to be adjourned for the arguments however at this stage oath taking ceremony has been conducted on joint request of the parties during which defendant No.1 has stated on special oath by placing his belief on the Holy Quran that he has not taken any amount even a penny from the claimant.

4. At this stage, claimant has accepted the oath of defendant No.1 and seeks withdrawal of the complaint.

5. On the basis of the request of the claimant in person confirmed by his learned counsel, the present complaint is hereby disposed off as withdrawn.

6. Parties are left to bear their own costs.

7. One attested copy each of this order is directed to be provided to the parties on filing the applications without court fee tickets even if on plain papers free of charges by entry with signatures in token of receiving in Dak Register with the clarification that extra copies would be liable to be issued at their own expenses.

8. The file of this complaint is to be consigned to the main record room D.G.Khan duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed for destruction in accordance with the Rules & Orders of Honourable Lahore High Court.
