APPLICATION FOR RESTORATION
1. The case is at the stage of the issuance of the notices to the respondents but I have taken out the file of the main complaint from the Ahlmad which is sought to be restored and found that it is permissible by the said order to restore the main complaint without providing the opportunity to the respondents for contesting the present application for restoration.
2. In accordance with above observation, the requirement of the issuance of further notices relating to the present application is dispensed with and replaced by the direction about the issuance of notices for pervi to the respondents after restoration of the main complaint by separate order to be passed in the file of the main complaint for further proceedings instead of issuance of the notices relating to the present application.
3. For what has been discussed above, the present application is hereby accepted subject to the payment of Rs.100/- per day as costs for the intervening period of the date of the impugned order and date of restoration and exparte order dated 13-09-2011 is hereby cancelled and the main complaint is hereby restored for further proceedings in accordance with law.
4. The file of this application is to be consigned to the record room duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed for destruction in accordance with the Rules & Orders of Honourable Lahore High Court.
