1. Parties have not been able to reach at a compromise despite availing many opportunities. Further grant of time would be wastage of time Faqir Muhammad etc filed a claim U/s 25 of the Punjab Consumer Protection Act 2005 with prayer that their grievances in respect of Rehman's Town, Harappa Station, Sahiwal be set at rest as per proclamation, agreement and banners On 20-12-11 the parties agreed for disposal of claim through appointment of local commission. Thereafter, on the same day, their joint statement was recorded. The parties amicably agreed to settle their dispute by way of appointment of local commission and his report. They agreed that the report of local commission shall be final and that they would have no objection for disposal of the claim in the light of report of local commission.

2. On the same day i.e 20-12-11, in view of joint statement of both the parties, Rana Usman Ahmad Sani Advocate (Joint Secretary Sahiwal Bar Association) was appointed as local commission. The local commission was directed to submit his report about the sewerage system, light/electricity, road, mosque, park, shopping center and appropriate places reserved for it. The local commission was directed to issue a prior notice to both the parties before visiting the disputed place.

3. On 03-01-12 Rana Usman Ahmad Sani Advocate (Joint Secretary Sahiwal Bar Association) filed his report which is part of record. The local commission had visited the disputed place in presence of both the parties after issuing them proper notice. The local commission filed the detailed report about the issues between the parties. Since the parties had agreed for disposal of the claim in the light of findings/observations of the local commission who was appointed with their mutual consent, therefore, further proceedings in the matter would be wastage of time. At one stage, the parties had desired to settle the dispute out of the court. They were provided money opportunities to arrive at some settlement but they failed. This court has therefore no option but to proceed in the matter as per joint statement recorded on 20-12-11.

4. The claim filed by Faqir Muhammad etc is accepted in terms of findings/observations recorded by Rana Usman Ahmad Sani Advocate (Joint Secretary Sahiwal Bar Association). The report of local commission Mark-A is made part of this order. The defendants shall be duty bound to act upon the findings/observations recorded by local commission within a period of 02 months positively failing which claimants shall be entitled to approach this court again for execution of this order.
