1. Case of the complainant is that he purchased leather poshish for 05 chairs of Sofa Set which was found substandard and started to rupture very soon. The respondent appeared in the court and submit reply to the claim stating that at the time of sale it was disclosed to the purchaser that the product is not of high quality, therefore, if the same was proved later defective respondent cannot be held responsible for that. The respondent during the proceedings did not choose to appear and due to his absence he was proceeded ex-parte vide order dated 17.12.2011. Complainant appeared in the court as Pw-1 in support of his claim. As no evidence from respondent side is available, therefore, the case is being decided on ex-parte evidence. Sale and purchase of the Poshish material is admitted by the respondent. It is also admitted that the product was not a high quality one. The sale of defective product is established by the respondent. In the circumstances respondent is directed to replace the Poshish sold to the complainant with new one free from any defect and also pay Rs. 2000/- the cost of litigation within one month of the passing of this judgment. File be consigned to record room after due completion.
