ResultN/A

1. The case is at the stage of the evidence of the claimant and payment of costs but since the writ petition filed before the Honourable High Court against order dated 01-08-2011 is being stated to be pending and since it is being requested by learned counsel for the claimant that the case may be adjourned for waiting the decision of Honourable High Court and may not be adjourned for the evidence of the claimant as such I find that since the case is already more than six months old as such it is proper to adjourn the case sine-die without fixation of the date so that the same may be refreshed after decision of the Honourable High Court by entry on new number if the same would be found to be maintainable by Honourable High Court after the decision of the Honourable High Court.

2. It is therefore clarified that the claimant would be liable to inform this court by filing formal application about the final order of Honourable High Court after disposal of the writ petition filed on behalf of the contesting defendants if the complaint is found to be maintainable by Honourable High Court.

3. It is also clarified that notices for pervi would be liable to be issued to the contesting defendants after resumption of the proceedings without issuing the notices relating to the formal application to be filed on behalf of the claimant during the proceedings of the main complaint after the decision of Honourable High Court.

4. Meanwhile the present file would be treated as having been disposed off sine die.

5. The file of this complaint is to be consigned to the record room duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed for destruction in accordance with the Rules & Orders of Honourable Lahore High Court.
