1. Order DCO/Authority through DDO (health) Sahiwal sent a reference U/S 23 (4) of the Punjab Consumer Protection Act 2005 with allegation that the respondent Miss Nasreen Kousar, being a quack, was involved in illegal practice.
2. The Learned Assistant Director Legal for the claimant and the respondent Nasreen Kousar were present in the court. The respondent submitted his written reply. She was also provided an opportunity of hearing.
3. The allegation against the respondent was that she was LHV and not authorized to use or prescribe allopathic medicines and run a clinic independently.
4. The respondent Nasreen Kousar, as per letter dated 14-07-09 issued by Greenstar Social Marketing, was an employee of City Health Services Executive based at Sahiwal Zone. The contract is effective from February 13, 2009. Her monthly emoluments are Rs. 12000/- including conveyance allowance.
5. She clarified in her written reply that she used to supply products and instructions of Greenstar to LHVs and Midwives working in districts Sahiwal, Okara, Harappa, Kassowal, Pakpattan and Arifwala.
6. According to her, on the date i.e 04-06-12 when the disputed place was visited, she was not working as LHV or Midwife or in any other capacity to provide medical facilities to the patients. She had assembled LHVs and midwives of the aforesaid locality in order to apprise them of products of Greenstar limited.
7. The inspection note prepared by DDO health Sahiwal would show that stethoscope, BP apparatus and other used medicines of routine nature were collected from 71/4-R, Sahiwal. It was not mentioned in the said inspection note that the said Nasreen Kousar was factually providing medical facilities to any patient and that the name of any patient was also not mentioned in it. If the report of DDO health Sahiwal, reply submitted by respondent accompanied by appointment letter of Greenstar Social Marketing dated 14-02-09 are put in a juxtaposition, one gets an impression that Mst. Nasreen Kousar was not running a clinic. She being representative of Greenstar Social Marketing had arranged a meeting of the local LHVs and Midwives to appraise them about the products and instruments manufactured by the above mentioned Company. The claim appears to have been filed on the bases of some misconception and without solid and confidence inspiring evidence. Therefore, further proceedings in the matter would be wastage of time hence the reference is filed without further proceedings.
