1. DCO/Authority through DDO (health) Sahiwal referred the claim U/S 23 (4) of the Punjab Consumer Protection Act 2005.
2. The reference/claim was sent on the basis of the report dated 05-06-12 prepared by DDO (health)
3. Sahiwal wherein it was mentioned that Mr. A.H Khan was not a qualified BDS dental surgeon and he was providing faulty services to the patients.
4. The respondent alongwith his counsel is present in the court. The statement of the respondent has been recorded separately. He made following statement before the court.
5. "I am neither a qualified B.D.S doctor nor I possess any decree to assist any B.D.S. However, I am working under qualified doctors as their assistant. I assure this Court not to work in this capacity in future. The clinic shall be run by the qualified doctor only."
6. The respondent Mr. A.H Khan admitted that he was not qualified to work as assistant with any BDS dental surgeon but despite that he was working as assistant to some dental surgeons. Patently, the respondent Mr. A.H Khan is at fault. He being un-qualified cannot work as assistant to any dental surgeon. Therefore, the allegations found in the /reference claim are found correct. The respondent Mr. A.H Khan is burdened with fine of Rs. 5000/- to be paid within 07 days from this order. He is also warned to remain careful in future. He shall not perform duty as an assistant with any BDS surgeon.
7. However, Khan Clinic may continue to do its work but under direct control and supervision of qualified surgeon. Registrar of this Court is directed to send copy of the order to DCO/Authority, Sahiwal for information and compliance of the order of this Court.
