1. Choudhry Muhammad Shabbir, the claimant filed an application before DCO/Authority Sahiwal with submission that Muhammad Ammar Tarique, Executive Ammar Engineering Sahiwal provided him generator which was later found defective. He contacted the defendant to repair the generator but without any result.

2. The DCO/Authority referred the matter to this Court U/s 23(4) of the Punjab Consumer Protection Act 2005.

3. The defendant resisted the claim and denied the allegations leveled against him.

4. The parties were provided a couple of adjournments to settle the dispute through negotiations. On 13-02-12 the defendant assured to supply the generator after repairing to the claimant but he failed.

5. Today i.e 15-02-12, both the parties were heard. Parties were provided an opportunity to negotiate with each other. After negotiation, the defendant undertook to retain the generator with him which was already in his custody/possession. He assured to return Rs. 2,25,000/- to the claimant till 10- 04-12. The claimant agreed with the offer made by the defendant. The signatures of both the parties were taken on the margin of the order sheet regarding settlement / compromise.

6. The reference made by Choudhry Muhammad Shabbir received through DCO/Authority Sahiwal is accepted in terms that the defendant shall return the price of the generator to the tune of Rs.

7. 2,25,000/- to the claimant till 10-04-12. The generator, in good or bad condition, is already in the possession of the defendant. If the defendant failed to pay the amount of 2,25,000/- to the claimant on or before 10-04-2012, the said amount shall be recovered through coercive measures.

8. Since the reference is being decided in view of the compromise arrived at between the parties, therefore, no order as to cost/fine is passed. If the amount of Rs. 2,25,000/- (two lac twenty five thousand) is not paid on or before date fixed, the claimant may approach this Court again for redressal of his grievances by way filing a simple application.
