' MALIK SABED EJAZ, J.-Brief facts of the case are that, respondent No.2 being customer under the petitioner, was issued a detection bill, as leis electricity meter was found running slow at the rate of 10%. This order was challenged before. The Electricity Inspector, who referred the matter back to the Advisory Board and ultimately the matter was decided in favour of the respondent by way of impugned order dated 14-2-2001, which has been assailed through this petition.
2. The learned counsel for the petitioner contends that Advisory Board had no jurisdiction to decide the matter in case of commission of theft. But no such objection was raised by the petitioner through out the proceedings before the Advisory Board though they remained in touch with those proceedings. Even otherwise, this petition suffers from laches, as it was filed after seven months of passing of the impugned order and there is no justifiable explanation for such delay. Apart from that it is also noted that neither the order of the Electricity Inspector has been placed on the file nor Electricity. Inspector himself has been arrayed as party to this petition. The accumulative effect of all what has been discussed above is that this petition fails and is accordingly dismissed.
