1. Learned Counsel for the respondents have frankly conceded that the respondents are ready to comply with the provisions of Article 11 PCPA, 2005. He has further contented that the respondents are already mentioning dates of manufacturing and expiry on the large packet of "Hilal Jelly Fish" but have omitted to mention these dates on the small packets. The samples of small packing have been collected by the Authority. He has committed that respondents will mention the dates of manufacturing and expiry on the small packets also. The large packet produced by the respondents has been observed by the court and it has been found that although the dates are stamped on this packet but the words of manufacturing and expiry are not mentioned thereon.

2. Therefore, the respondents are directed to mention these words on the large packets and also the manufacturing and expiry dates on the small packets. The learned counsel for the respondents has pointed out that the reference submitted by the Authority is not supported by an affidavit which is legal requirement of Article 11 PCPA, 2005. The objection raised by the learned counsel is correct.

3. Therefore, the Assistant Director (Legal), Bahawalpur has been directed to comply with the said provision strictly in future who has also noted the said direction and has promised to comply with.

4. The learned counsel for the respondents has not strongly pressed on the dismissal of the reference on the basis of this objection. Therefore, the reference in hand stands proved and is decided in favour of the Authority and against the respondents in the light of above observations. File be put for execution and report by the Authority on 21-02 2012.
