Brief facts of the case are that on 24-11-10, the petitioner handed over cloth of four suits to the respondent for stitching purpose which he promised to return on 14-12-10 but he did not do the needful despite petitioner's repeated demands. Then on 31-12-10, the petitioner issued legal notice to the respondent demanding him to redress his grievance otherwise respondent should pay him cost of cloth amount to Rs.10, 000/- but the respondent did not, hence, this petition.

2. In response to issuance of court process, the respondent appeared before court but on 15-12-11 nobody appeared from respondent's side, therefore, they were proceeded ex-parte.

3. Petitioner appeared as PW-1 and also placed on record his sworn affidavit Ex-P-1, copies of legal notice Ex-P-2, courier receipt Ex-P-3 and sale receipts Ex-P-4 & Ex-P-5.

4. Ex-parte arguments heard and record perused.

5. As petitioner's evidence has not been rebutted by respondents due to ex-parte proceedings, therefore, petitioner's claim is granted for recovery of Rs.16, 900/- as prayed. As regards award of punishment on the respondent, petition is dismissed to this extent. After due completion, file be consigned to record room.
