APPLICATION FOR BLOCKING OF SIM

3. The file is at initial stage. The grievance of the petitioner is to the effect that order dated 25-01- 2012 passed by this court about restoration of disputed mobile telephone sim was to be implemented in case of non filing of appeal but the same has been implemented by the concerned company during the pendency of the appeal before Honourable High Court which was filed on behalf of the present petitioner namely Nawab-ul-Hassan having been admitted on 08- 03 2012 while disputed sim was restored on 18-04-2012. The petitioner has requested to block the sim by way of the present application.

I have come to the view after perusal of the application in the light of the arguments being advanced by learned counsel for the petitioner that since the dispute between the parties is subjudice before Honourable High Court as such it is proper for the petitioner to move the application before Honourable High Court for the redress of his grievance with the observation that the concerned company should have and might had taken the affidavit of rival party about non filing of appeal because the compliance of the order of this court was subject to the filing of appeal and the concerned company was not bound to implement the said order during the pendency of the appeal.
5. In accordance with above situation, the present application is disposed off by way of return.
6. No order as to costs.
7. One attested copy of this order is directed to be provided to the petitioner and one copy to the respondents jointly on filing the applications without court fee tickets on plain papers free of costs by entry with signatures in token of receiving in Dak Register with the clarification that extra copies would be liable to be issued at their own expenses.
8. The file of this application is to be consigned to the record room of this court duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed for destruction in accordance with the Rules & Orders of Honourable Lahore High Court.
