COMPLAINT ABOUT FAULTY SERVICE OF MEPCO REALATING TO CONNECTION NO.19-15724-0741600-R ORDER:
1. The case is at the stage of the issuance of the notice to the defendant which is shown to have been issued but no report has been received about the compliance and fresh notice is required to be issued but I have observed that the complaint is not maintainable in present form because the version of the claimant is to the effect that the defendant is the employee of the electric company as meter reader who has removed his electric meter with threats about payment of illegal charges while the Exen has taken no action on the legal notice sent on 15-11-2011 and that the claimant has wearied out by circling the local office of MEPCO as such I find that the meter reader cannot be sued in his personal capacity without impleading as party the concerned company through chief executive of Multan Electric Power Company while the Exen is also proper party to be impleaded according to the contents of the complaint.
2. I have observed that effective order cannot be passed against the meter reader without impleading the employers as parties. Another defect in the complaint is about non verification of the complaint as required by Rule 13 (1) of PCP Rules 2009.
3. It is therefore observed that instead of dismissal of the complaint on technical grounds, it is in the interest of justice to return the complaint for fresh institution and for issuance of legal notices to concerned company and to its officers including the meter reader and for impleading the company through its officers as parties and for due verification of the complaint in accordance with law.
4. In accordance with above mentioned observations, the complaint is hereby disposed off by return.
5. Parties are left to bear their own costs.
6. A copy of this order is to be sent by post to the Exen concerned at the responsibility of the Ahlmad for information and for timely redress of the grievance of the claimant so that the consumer may not resort to file fresh complaint.
7. A copy of this order is being made available for publishing on the internet to the website of Punjab Consumer Protection Council Secretariat, 135-J, Model Town, Lahore for public disclosure and easy access of information to the consumers relating to the products and services in accordance with Rule 25 of PCP Rules, 2009.
8. The file of this complaint is to be consigned to the record room of this court duly page marked with proper index and after due completion and made available for issuance of attested copies and kept under safe custody till the period fixed for destruction in accordance with the Rules & Orders of Honourable Lahore High Court.
