' This is a petition for transfer of a suit for restitution of conjugal rights filed by the respondent against the petitioner and which is pending before Ch. Nabi Ahmad, Judge Family Court, Chakwal to the Court of Judge Family Court, Bhalwal.

It is not denied by the learned counsel for the parties that the petitioner is the wife of the resp ondent and that they were living in Chakwal District Jehlum, when on account of differences she filed a suit on 25-6-79 for the dissolution of her marriage with the respondent. This suit was filed at Bhalwal where the petitioner had gone after the differences between the spouses and is presently pending disposal before Khawaja shoukat Iqbal. Judge Family Court Bhalwal. According to the petitioner as a countermeasure the respondent filed the suit afore referred for restitution of conjugal rights on 10-3-1980 against the petitioner. Learned counsel for the respondent who had a copy of the plaint admits that the petitioner who is a defendant in the said suit is shown to be residing at Bhalwal in the heading of the plaint.

On account of differences between the parties and the litigation between them apprehension has been expressed by the petitioner that in th event of her going to Chakwal for the dates of hearing she will be harassed. Bhalwal is at quite a distance from Chakwal and in the circumstances of the case and in the interest of justice I hereby direct transfer of the suit for restitution of conjugal rights filed by the respondent against the petitioner pending before Mr. Nabi Ahmad, Judge Family Court, Chakwal, for hearing and disposal to the Court of Khawaja shoukat Iqbal, Judge, Family Court, Bhalwal where the petitioner's suit for dissolution of marriage is pending.
Petition accepted. Disposed of.
