1. The version of the complainant is that she applied two years ago for connection of electricity for her house situated in Baloch Colony, Mouza Karna, Bahawalpur but the respondents No.1 to 3 have not issued demand notice to her; that two years earlier, she was informed that her file has been misplaced. So, she moved second application No.402 but the respondents are not issuing demand notice to her. Whereas, they have supplied electricity to other residents of the said colony. In this way, the respondents have failed to provide services to the complainant. She has issued legal notice to the respondents but they have not taken notice of it. Respondents No.4 has contended that he has not sold any plot to the complainant. Hence, this complaint.

On the other hand, the version of the respondents is that where the complainant demands electricity connection that is Goheer Town and no transformer has been got installed thereon by owner of the said town and under the WAPDA policy, no connection can be provided to any person without the existence of transformer. The respondents have no funds for the installation of transformer for provision of connections to the complainant and other residents of Goheer Town.

3. No connection can be provided under the letter No.1987/M dated 09-12-2010. So, the complaint is liable to be dismissed.

After hearing the arguments and perusal of the record, I have observed that the complainant has attached with his complaint, photographs of meters Ex-P1 to Ex-P7 which make out that the respondents No.1 to 3 have installed meters for different peoples in Baloch Colony. The complainant has also placed on record, photo copy of the sale deed Mark-A (4 pages), map of her plot Mark-B, copy of registered record of rights Mark-C to make out that she has purchased a plot for construction of her house thereon which is situated in Baloch Colony, Mouza Karna, Bahawalpur.

5. She further has produced copy of letter No.2521 dated 29-12 2010 written by Engineer Mohammad Javed Iqbal, Manager (M&S) Mepco, Bahawalpur Mark-D. Through this letter, the said Engineer has proposed that the scheme of Goheer Town be approved through P&E, Mepco where connections have already been installed. The complainant further has produced receipts MarkD-A to Mark-F.

Whereby, some residents of the Baloch Colony have deposited amounts for different services to T.M.A. The complainant further has placed on record copy of order dated 10-02-2012 passed by Honourable Lahore High Court, Lahore, Bahawalpur Bench in writ petition No.6470/12/BWP titled Syed Saadat Hassan Gilani Vs Manager Operation SE, Bahawalpur etc "that respondent No.1 is directed to look into the grievance of petitioner and decide the same in accordance with law within a shortest possible period, as the petitioner has applied for domestic electricity connection. Further that the petitioner will appear before respondent No.1 in order to redress her grievance." In pursuance of the order passed by the Honourable Lahore High Court, Lahore, Bahawalpur Bench in above titled case where in the same matter is in issue. The respondents No.1 to 3 are directed to look into the matter for redressal of the grievance of the complainant in accordance with law in the short possible time.

7. The complainant will appear before the respondent No.1 for getting relief. It is to be kept in mind that the parties are bound to comply with the rules given in letters Mark-R1 and Mark-R2.

8. Respondents No.1 to 3 cannot supply any connection of electricity without issuance of NOC by the TMA, City, Bahawalpur. With these observations, the petition in hand is disposed of. File be put up for execution on 28-07-2012.
