' After having heard learned counsel for the petitioner as also learned counsel for the respondents this petition can be disposed of with consent in the following terms:-- ' It appears that the grievance of the petitioner who is one of the victims of Crime No,69 of 2009 which was registered at Police Station Sanghar is that the accused in the matter are not being diligently pursued by the police and they are not being arrested, ' On the other hand learned counsel for the respondents states that after proper investigation the matter has been challaned and it is now in the hands of the learned trial Court to take such action to ensure the attendance of the accused as is required and permissible under the relevant provisions of the Cr.P.C.

' In view of the statements made by learned counsel for the petitioner as also learned counsel for the respondents, this petition is disposed of in terms that the petitioner may within fifteen days from today make an appropriate application before the learned trial court where according to the instructions of learned counsel for the petitioner the matter has been put on dormant file. On such application the learned trial court shall take all such action as required under the Code of Criminal Procedure to ensure the attendance of the accused and for this purpose it shall issue all necessary orders and the concerned police authorities are hereby directed to provide all such assistance to the learned trial court as is required under the law. The learned trial Court shall also issue notice to the D.P.O. Sanghar who shall direct a responsible officer to be in attendance before the learned trial Court and file a report as to what efforts are made by the subordinate police officers to ensure the attendance of the-accused as per the challan. If no positive action is forthcoming within thirty days from the date of the application moved by the petitioner then the learned trial Court shall make a report to this court which shall be placed on record for such suitable orders as may be deemed appropriate.
3. ' Subject to the foregoing this petition is disposed of.
