ORDER

TARIQ JAVED, J. --- The petitioner applied for admission into three years diploma course being conducted by the Government Polytechnic Institute for Women Qasimpur, Multan. Her application for admission in the said diploma course was rejected on the ground that she was over aged by three years and hence she was not entitled to the admission.

The learned counsel for the petitioner contended that there are number of seats vacant and the petitioner has been denied admission on a technical ground that she is over aged and hence not entitled for admission. Her representation was made to the Principal, who turned it down as according to him he was not competent to relax the age of three years and hence her request was turned down and then the present writ petition was instituted. Notice was issued to the respondents.

3. It is stated on behalf of the respondents that the seats are still vacant. However, the petitioner is over aged by three years and as such she is not qualified for admission. The competence of the respondent No. 1 is to relax the age limit only for one year. As such the case of the petitioner is not within his competence.

4. Since the seats are vacant. The Government funds are being utilized and admission is being denied to the petitioner, who is a woman on a technical ground of having passed the age of admission. The college authorities could have been mindful of the 'need of education for women, and the waste of tax-payers money by keeping the seat vacant. It is stated by the representative of the respondent No. 1 that the petitioner by interim order dated 18.12.2009 nas already been provisionally admitted.
