' DOST MUHAMMAD KHAN, J.---The latter stated that because of the approval of the Chief Executive of the Province that the old hospital be retained/maintained as Women and Children Hospital while the new one is to be the main hospital of District Swabi and shall remain functional, however, it was stated that some deficiencies of little nature would consume some time to be made good.
However, during deliberation it came to light that these deficiencies are not of the nature to consume a time of sixty days, as was stated by the Director General Health Services, therefore, as a last chance thirty days time is allowed to the respondents so that the new hospital of District Swabi is made fully functional for health care of the public. The old staff be divided according to their own wisdom, otherwise in 2/3rd and 1/3rd ratio between the-new and old hospital.
2. The Director General Health Services, present in 'court, shall visit Swabi and shall hold a meeting with all the stakeholders including the DCO and DPO Swabi who too shall attend the meeting and to extend full cooperation in the matter to the authorities of the Health Department and, if need be, the local DCO/DPO shall provide additional security force to the hospital for a month or two according to the need, however, in all circumstances the new hospital shall be made functional positively within thirty days.
3. It was stated at the bar that the Provincial Finance Department is not releasing certain amount/ according due financial approval required for making operational the hospital. The Secretary Finance, Government of N.W.F.P., is directed to release the entire amount due within seven days to the Health Department and to accord the due approval for filling certain vacancies. Any unnecessary delay on- the part of Finance Department would be construed as defiance of the court order. The Director General Health Services shall also look into the needs of the area and, if necessary, shall direct the transfer of additional medical staff including specialist doctors and nursing staff to the new hospital. Petition stands disposed of accordingly.
