1. ' Mr. S. Fazal-ur-Rehman, learned counsel for petitioners, submits that mosque has been constructed on an amenity plot unauthorizedly without approved building plan. According to Mr. Masroor Ahmed Alvi, learned counsel for respondent No, 5, they have applied for regularization and the matter is under consideration for mosque.

' Therefore, by consent, it is ordered that except mosque with attached Wazookhana shall, for the time being, be not disturbed and rest of the construction, if raised, shall be demolished and the encroachment shall also be removed and amenity area reserved for park be restored including the 10 feet lane covered by construction as shown in the Nazir's report shall also be cleared and free access to the residents of area to be made.
3. ' The C.D.G.K. And Town Administration shall process the application for regularization and approval of mosque strictly in accordance with law, rules and regulations applicable thereto within a period of 30 days.
4. ' Let respondent No, 5 voluntarily remove all such construction within 30 days otherwise C.D.G.K. And Town Administration shall take action for removal and restoration of the same. The petition in above .Terms stands disposed of along with the listed application. revisions by the competent authorities.
