The first respondent, Mst. Maryam Bibi, hereinafter referred to as the respondent, made an application against the petitioner, Malik Abdul Qadoos, for his ejectment from a shop. It was alleged by her that she Deeded the shop for her son, namely, Nasrullah as he wanted to do business, relating to hardware, in the said shop. Her plea had found favour with the Rent Controller who had heard the ejectment application. As a result, the petitioner was asked to vacate4the disputed shop. He went in appeal before the appellate authority (District Judge) but without success. He has, therefore, filed this Constitutional petition to assail the orders of the two tribunals below.
2. Learned counsel for the petitioner contended that the respondent had other shops also and, therefore, her requirement for the shop in question was not bona fide. Admittedly, the other shops of the respondent are occupied by different tenants and are not available for immediate occupation by her son. Therefore, her mere ownership of other shops does not detract from the genuineness of her requirement for the disputed shop. In the circumstances in which the respondent was placed, it was her prerogative to ask for vacation or any of the shops occupied by her tenants with a view to accommodating her son and thus there was no harm if she had selected the shop in question for the purpose

It was also urged by the learned counsel that the aforementioned sign of the respondent was running a factory for manufacturing chromium polish and, therefore, he was not in need of the shop in dispute. It appears that the said factory is a joint enterprise which is being carried on by her son and others and, therefore, there is no bar to his asking for-the shop in question for doing another type of business independently.
4. There is concurrent finding of the two tribunals below that the respondent reasonably and in good faith requires the disputed shop for her son and nothing has been pointed out by the learned counsel to enable me to interfere with their unanimous verdict.
