1. ORDER SHAHID ANWAR BAJWA, J.---In view of the order I propose to pass, office objection need not to be decided.

2. Learned counsel for the petitioner states that on directions of this Court statement of P.Ws. Akhtar Ali and Nabi Bux have also been recorded by the police. He submitted that police is not submitting report under section 173., Cr.P.C.

2. Vide order dated 2-12-2009 police officials and S.P. Investigation were restrained from submitting report under section 173, Cr.P.C. Learned counsel states that he would be satisfied if police authorities are directed to submit their report after taking into consideration the statements of all the witnesses in general and Akhtar Ali and Nabi Bux in particular before the concerned Judicial Magistrate and thereafter the Judicial Magistrate is directed to pass well considered and reasoned order. He submits that he would be satisfied if such direction is issued.

3. The restraint order- passed on 2-12-2009 is recalled. Police authorities are directed to submits a well considered and proper report before the concerned Judicial Magistrate who is directed thereafter to pass an administrative order after considering all the evidence and the record and in accordance with the law.

4. With the above direction, this constitutional petition is disposed of.
