1. ' M. SALEEM CH AUDHRY (CHAIRMAN).-In this case the appellant, an Ex-Constable, is aggrieved by the order of S. P., Multan dated 14th February, 1977 dismissing him from service on the grounds that he was involved in a corruption case vide F. I. R. No, 5 dated 4th January, 1976 registered under section 30, P. P. C. At Police Station, Saddar, Multan. He is also aggrieved by the order of D. I.-G., Multan dated 29th June, 1977 rejecting his appeal and the orders passed in revision by the I.-G.
2. Police on 22nd June, 1978. It is evident that the appellant at the relevant time being in Jail could not participate in the proceedings. However, it is contended that his revision to I.-G. Police stood rejected by his orders dated 22nd June, 1978, and the present appeal filed on 13th March, 1979 is barred by time. The appellant claims that the order passed by the I.-G. Police was not communicated to him. The letter dated 4th February, 1979 (at page 36) also indicated that his revision petition already stood rejected and this was the only letter received by him. The appellant preferred this appeal on 13th March, 1979 which was accompanied by application under section 5 of the Limitation Act claiming condonation of delay on the grounds that I.-0. Police's order dated 22nd June, 1978 was never received by him. The only communication which reached him was dated 4th January, 1979 which he received on 10th February, 1979. Thus after preparing the appeal on 11th March, 1979 he filed it on 13th March, 1979.

' The learned Government Pleader contended that the appeal preferred by the appellant in any case is time barred by one day as the appellant was required to file the appeal within 30 days which expired on 12th March, 1979. It is submitted that since the appeal was ready on 11th March, 1979 there was no ground for delaying the filing of this appeal till 13th March, 1979. The appellant has failed to advance any explanation for the delay in question. According to law, the appellant was required to explain the delay for each and every day. The learned counsel for the appellant has not been able to explain the delay as per objection by the Government Pleader. In fact the application for the condonation of delay Is also silent in this regard. We have thus no choice but to dismiss the appeal as barred by time.
