1. MUNIB AHMED KHAN, J.--- The petitioners have filed amended title, which is taken on record. Mr. Gulab R.I Jessrani has filed English translation of annexure "A" which is also taken on record. The D.D.O Revenue, Kashmore has filed a report, in which he has stated that he has not completed the demarcation as the direction was issued to D.D.O., Revenue, Kandhkot. The report is also taken on record. The claim of the petitioners is that they on 25 acres of land, upon which the respondents No. 5 and 6 are rising construction. This fact has been disputed by learned counsel for the respondents Nos.5 and 6 and he states that they are raising construction on their on land acquired under the Land Acquisition Act. Both the learned counsel agreed that the land may be demarcated by respondent no.3 (Deputy District Officer, Revenue, Kashmore) with the assistance of Superintendent, Survey Department, Larkana. The learned counsel also agreed that in the meanwhile respondents No.5 and 6 may continue with the construction of the boundary wall on their on cost and risk. He further submits that after demarcation if it is found that some construction has been raised upon the land of the petitioners, the respondents will pay the compensation to the petitioners at the available market rate. The respondent No.3 is directed to submit his report of demarcation keeping. In view the title documents of the parties within fifteen days and the Survey Department, Larkana is directed to provide all assistance to the respondent No.3. Adjourned.
2. The parties are directed to be available at the site on the date of demarcation to be communicated by respondent No.3. .
