ASAD MUNIR, J. --- According to the petitioner, he got married to Mst. Saira Riaz by means of a 'Nikah Nama' dated 10.3.2009 but the said Mst. Saira Riaz against her will is being illegally detained by her father, respondent No. 1.
2. By this Court's order dated 24.9.2010 a bailiff was deputed to recover and produce the said Mst.
Saira Riaz before this Court today. Mst. Saira Riaz present in Court has stated that she is not married to the petitioner but is married to Sikandar Abbas. 'Nikah Nama' dated 1.10.2009 evidencing her marriage with Sikandar Abbas has also been submitted. Parents of Mst. Saira Riaz, who are also present in Court, stated that their daughter is married to Sikandar Abbas instead of the petitioner.
At the same time, Mst. Saira Riaz expressed her opposition to go with the petitioner as she stated that she is happily married to Sikandar Abbas.
3. In view of the statement of Mst. Saira Riaz, I am satisfied that she is not in illegal and improper custody.Of respondent No. 1, who is her father. As such, this writ petition has no merit and the same is accordingly dismissed.
