Moazzam Hayat, Member.--Appellant Hamid Noor is a Sub-Engineer in the service of WAPDA. In the year 2008 he tried for his transfer to Golen Goal Project Chitral. Instead he was transferred, to the Office of Superintending Engineer Small Hydel Power Station Mangla vide order dated 25.08.2009. He reported at Mangla Hydel Power Station but was told that in that office there was no post available. He was, therefore, transferred to the Office of Chief Engineer Tarbela vide order dated 17.10.2009. The earlier order of transfer to Mangla was cancelled: The representation made by him against his transfer to Tarbela was not responded. Hence this appeal.
2. The appeal is resisted by the respondent. It is stated that the transfer is an administrative matter in which the Tribunal cannot interfere.
3. The appellant is not present. His son is present but he has no authority to appear on his behalf.
We shall, however, not dismiss the appeal in default and proceed to decide it on merits. We have heard the learned counsel for the respondents and have also perused the record including the memo. of appeal.
4. It is mentioned in the memo. of appeal that the appellant had certain secrets with him due to which he had been transferred. He did not explain the nature of secrets. In our view transfer is an administrative matter in which the Tribunal cannot interfere unless the transfer order is mala fide or against the rules. In the present case the transfer was made strictly in accordance with the rules.
No mala fide was involved. The allegation with regard to 'secrets' being ambiguous and vague cannot be taken into consideration.
5. In the above circumstances, we find no merit in the appeal which is hereby dismissed.
