1. ' On 22-11-2010 learned representative of the complainant department was directed to get the site inspected for verifying the respondent's undertaking to keep the area of respondent unit clean and disinfected and not to let the litter scatter about.
2. ' The requisite current status report of the respondent unit has been filed which contains the following information.
(1) There are two poultry farms/units at the site.
(2) Both the sheds are functional.
(3) One Burial Pit is available on poultry farm for dead birds.
(4) One solid waste storage room is available at the said poultry farm.
(5) One Soakage Pit is available for liquid waste disposal.
(6) Two workers are working in the poultry farm.
3. ' The above mentioned report shows that the respondent has complied with the directions contained in the EPO and has also abided his undertaking. The complaint is therefore disposed of as fructified.

' I disagree with the order dated 17-1-2011 passed by the worthy Chairperson due to following reasons:-- ' The instant complaint was filed on 4-10-2010 by the complainant Environmental Protection Agency against the respondent unit through its owner Maqsood Ali Shah, who entered appearance on 2-11-2010 and filed his reply wherein he denied all the allegations levelled in Environmental Protection order and further submitted on 22-11-2010 that he will keep the area clean and disinfect and will not let the solid waste of his poultry farm scatter to contaminate the natural stream of the area. To confirm the statement of respondent, the department was directed to conduct the site inspection.
6. ' The site inspection report produced on 17-1-2011 conducted by Inspector Inam-ul-Haq reveals that although preventive measures has been adopted by respondent, but distance of respondent Poultry farm from residential area and from natural streams is not mentioned. The S.I.R. Annexed with the complaint disclose the facts that respondent unit is situated in Rawal Lake catchment area and closer to natural streams in the area and residential area of the village.
7. ' The guidelines regarding the poultry farms specifically mention the distance of poultry farms from human settlement which is 500 meter. That is why distance is required to be measured specifically to arrive at just and proper decision and without these measurements the complaint may not be disposed of.
