ORDER

1. ' On 22-11-2010 it was stated by the tenant of respondent No, 1 that the Soakage Pit as well as Burial Pit were already provided by the owner when he took over the poultry farm.

2. ' Learned representative of the complainant department was directed to get the site inspected for verifying the statements of the tenant and file report on 20-11-2010 when the Tribunal did not function and the complaint was adjourned for today.

3. ' Learned representative of the complainant department has filed the current status report of the respondent unit which contains the following findings of inspector EPA Rawalpindi.

(1) The poultry unit is comprising of two storey building (functional).

(2) Mortality Pit is available on poultry farm for dead birds.

(3) One solid waste storage room is available on the said poultry farm.

(4) Soakage Pit was observed on the poultry farm.

(5) The poultry farm is built near the Korang river.

4. ' The above mentioned report reveals that compliance of the directions issued by the complainant department has already been made by the respondent. As regards the finding that the poultry farm is located near the Korang river, it is directed that the respondent shall take all the precautionary measures to ensure that solid and liquid waste do not pollute the river.

5. With the above directions the complain is disposed of.

7. ' I disagree with the order dated 17-1-2011 passed by worthy Chairperson due to the following reasons:

(i) The Site Inspection Report filed on 17-1-2011 by the complainant department reveals that respondent poultry farm is situated near the Korang River. Although the exact measurement of the distance lies between the Korang River and the respondent poultry farm is not given by the complainant department but as it is situated near the Korang River, so it is apprehended that respondent poultry farm will polute the natural reservoir.

(ii) It is also embodied in the para 2.3 of the guidelines adopted by the Pakistan Environmental Protection Agency that poultry farms should be situated 500 meters away from the human settlement and on the leeward side as the respondent unit is near the Korang River therefore, it is to be shifted 500 meters away from the human settlement area.

(iii) Disposed of. The file may be consigned to record room after its completion.
