' S. ALI HASSAN RIZVI, J.---This writ petition arises out of impugned order, dated 17-2-2009 passed by the learned Additional District Judge in two rent appeals pending before him. The petitioner in a rent matter already pending had filed an application under Order, I Rule 10, C.P.C. For his implement as party which was dismissed by the learned Special Judge (Rent) on 20-12-2008 but at the time disposal of appeal along with the connected appeal titled "Muhammad Mazhar and others v.
Zulifqar Haider" learned appellate Court failed to pass any order on the appeal filed by the petitioner titled "Mst. Bilqees etc. v. Zulifqar Haider".

Learned counsel for the respondents subscribed his view with the version of learned counsel that the learned Additional District Judge as appellate Court while passing the order, dated 17-2-2009 did not pass any order in the connected appeal and he has no objection if this writ petition is disposed of with the direction to the learned appellate Court to decide afresh to the matter and gave his decision on the connected appeal pending with him titled "Bilqees v. Zulifqar Haider".
3. Resultantly, the impugned order, dated 17-2-2009 is set aside. The case is remanded to the Additional District Judge for decision afresh on the appeal titled "Mst. Bilqees and others v. Zulifqar Haider" within two months from the date of receipt of order. The writ petition stands accepted. revisions by the competent authorities.
