SAGHIR AHMAD, J. - Petitioner seeks post-arrest bail in case F.I.R. No. 322, dated 29.8.2008 under Section 399, P.P.C. Police Station Abadpur, Rahim Yar Khan.
2. Heard. Record perused.
3. According to the F.I.R. Itself, the policy party had received a spy information about presence of the accused including the present petitioner making preparation to commit dacoity, therefore, the policy party consisting of about eight members, duly armed raided apprehended from the spot.
The above prosecution story prima facie does not attract the mind of a man with common prudence. Apart from that the allegation against the petitioner is only that of ineffective firing. The petitioner is behind the bars without any substantial progress in the trial and no useful purpose would be served by keeping him behind the bars for an indefinite period. Resultantly, this bail application is allowed and petitioner is directed to be released on bail subject to furnishing bail bond in the sum of Rs. 1,00,000/- (Rupees One lac) with one surety in the like amount to the satisfaction of learned Trial Court.
4. It is made clear that whatever has been observed is purely a tentative assessment and shall not influence the learned Trial Court while deciding the fate of the trial.
