Brief facts of the case are that in August 2010 supply and fixing of tiles in petitioner's house was completed by the respondent for which respondent received total payment of Rs.9720/-. After completion of tilework, petitioner found that the same was not done properly. When petitioner complained to the respondent about substandard work / defective service rendered by him, he first promised to redress petitioner's grievance but ultimately refused. He also did not respond to petitioner's legal notice dated 24-9-10, hence, this petition for recovery of suit amount of Rs.1,72,155/- on account of physical / mental torture and damages.
2. Process was issued for the appearance of respondent but he did not turn up despite service. He was, therefore, proceeded ex-parte.
3. Petitioner appeared as PW-1 and documentary evidence in support of his claim i.e. Copies of legal notice EX-P2, postal receipt EX-P3, acknowledgment card EX-P4, cash receipt EX-P5 and estimate tiles receipts EX-P6 to EX-P8.

As already stated, petitioner's evidence has not been rebutted by the respondents since proceeded ex-parte, therefore, the petition is accepted ex-parte for recovery of Rs.60,000/- including Rs.25,000/- compensation for damage caused to the petitioner, Rs25,000/- for damages on account of physical and mental discomfort and Rs.10,000/- as litigation expenses whereas petitioner's remaining claim is hereby dismissed. After completion, file be consigned to record room.
