1. The main contention of the complainant is that he submitted his form for appearance in Intermediate Exam vide Diary No. 8096. He did not received any objection form or Roll No. slip by the respondents till 24.5.2010 while as per date sheet the first paper of the complainant was on 25.5.2010. On 24.5.2010 the complainant went to the Board of Intermediate Multan where he was informed that there is an objection on his application form and in this regard a letter has been sent to the petitioner. On production of stamp paper / affidavit the complainant was issued Roll No. slip on 24.5.2010. The complainant never received any letter from Board Office allegedly sent to him. In this way the respondent No. 1, 2 & 3 are providing faulty services to the students and due to faulty service of the respondent the complainant faced mental torture and agony due to behavior of the respondent and he has claimed compensation of Rs. 5 lacs. On behalf of the respondent No. 1, 2 & 3 the allegations have been denied and version has been taken that the objection letter was duly sent to the complainant through respondent No. 4 & 5 to the complainant in time. Respondent No. 4 & 5 have also denied the allegations leveled against them through their written reply.

The main contention of the complainant is that he did not receive his Roll number slip or any objection letter allegedly sent by the Board Office to him and that on 24.5.2010 he himself enquired about the matter from the concerned Board Office Authorities and on submission of his affidavit objection letter and Roll No. slip were issued to him. While the complainant had to appear in the examination of intermediate Part-I on 25.5.2010 and in this way the complainant has alleged that the respondent No. 1, 2 & 3 are providing faulty services to the students. On behalf of respondent No. 1 to 3 a register has been produced in the court which shoes that at Sr. No.241 a letter was handed over to the Post Office in the name of the complainant with Roll No. 124930. In the end of Sr. No. 487 stamp of the post office shows that the post was handed over to the postal authorities on 29.4.2010.

Although on behalf of respondent No. 4 & 5 receipt of post has been denied but the stamp of the post office shows that the concerned post was handed over to the respondent No. 4 & 5 on 29.4.2010 which is well in time before the commencement of the exam i.e. 25.5.2010. In this way respondent No. 4 & 5 are responsible for the faulty service as they did not deliver the concerned objection letter sent by the respondent No. 1 to 3 to the complainant in time rather never. This all shows that respondents No. 4 & 5 are responsible for the faulty service and they are responsible for the grievance and mental torture faced by the complainant. Therefore the complaint is hereby accepted with costs and the respondent No. 4 & 5 are directed to pay compensation of Rs. 5000/- along with fee of the counsel to the petitioner. To some extent respondent No. 1, 2 & 3 has also to facilitate the complainant. Therefore respondent No. 1 to 3 are directed not to charge any fee for appearance of the complainant in intermediate examination Part-I which is going to be held as per next schedule from to day. File be consigned to record room after its due completion.
