' IJAZ AHMAD CHAUDHRY, J.---The grievance voiced by the petitioner is that she was of 20 years and one month of age at the time of filing of application for the post of Educator and she was fully qualified but the Call Letter is not being issued to her for appearance in interview on the lame excuse that the petitioner was less than 20 years of age on 1.7.2008.

Learned counsel for the petitioner contends that the date for filing application form was fixed 7.5.2009 but it has been wrongly mentioned in advertisement that candidate should not be less than 20 years of age on 1.7.2008 when the policy was made; that the said order is illegal and may be set aside to this extent as the age limit should be fixed from the date when the applications are invited and not when the policy was made.
3. Learned Addl. Advocate General has opposed this petition.
4. I have heard the learned counsel for the parties and perused the documents attached with this petition.
5. It seems that there was no justification for fixing the date for considering the age of a candidate lower and upper when the policy was introduced. It is never happened that the date is to be fixed for the said purpose and it was always the policy of Government to consider the age on the last date of filing of application for any post. When the application were to be filed for the post of Educator last date was 7.5.2009 and petitioner was qualified as she was more than 20 years of age by then. There is no justification put forward by the respondents that why cut date for considering the age limit was fixed 1.7.2008 as against the normal policy of fixing the last date for filing the applications in this respect. The petitioner has been deprived of her right to contest for the post of Educator being eligible for the same. Hence, this writ petition is accepted and the petitioner will be issued call letter in response to the application already tendered by her and on a date fixed by the respondents the petitioner will also be interviewed by the competent authority and considered alongwith the other candidates for the post of Educators. The learned Addl. Advocate General shall ensure compliance of this order.
